Notwithstanding subsection (1) or a rule, regulation or by-law of the council, the council with the approval of the town planning commission may permit a building, replacing on the same site a building damaged or destroyed by fire or being an extension or addition at the rear of an existing building, to be erected nearer than 8.33 metres from the centre of a road or lane in the city where, in the opinion of the council, the road or lane is not adaptable to widening or does not or will not require widening in the public interest, provided that no building shall be permitted to encroach on an existing road or lane. Where the city becomes liable to pay guaranteed securities, it may provide for the payment of them out of the general funds of the city or by the issue of debentures payable within a term not exceeding 10 years from the issue of them, and it shall not be necessary to obtain the assent of the Legislature, to a by-law providing for the issue of the debentures.
Where the revenue falls short of the sums required to meet the estimated expenditure, the council may direct that the deficiency may be deducted from the appropriations made.
